Agreement to Terms

By accessing or using the River Valley Town Square website (rvtownsquare.com) and related services (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree, please do not use our Services.

The Services are operated by High Desert Media LLC, d/b/a River Valley Town Square, located in Russellville, Arkansas.

Description of Services

River Valley Town Square builds and hosts websites for local businesses in the River Valley region of Arkansas. That includes free website mockups, website design, hosting, ongoing edits, and the tools that connect a site to the way a business takes requests and bookings. We also publish community stories and resources for the region.

Website Plans and Billing

Website plans have two parts: a one-time setup fee and a monthly plan. Base is $499 setup and $20/mo. Pro is $999 setup and $99/mo.

The setup fee is due today, when you sign up and pay through our secure checkout (Stripe).
Monthly billing starts at launch, 30 days after you sign up. If your site launches sooner, we may start the monthly plan on launch day. After that, your card is charged once a month.
No contract. You can cancel any time from the billing link in your welcome email, or by contacting us. Cancellation takes effect at the end of the month you have paid for.
You can update your card and see your receipts from the same billing link.

SMS/Text Messaging Terms

When you request a free mockup on our start page, claim a mockup we built for you, or use our text sign-up page, you can choose to give us a mobile number and tick a box that says “I agree to get texts from River Valley Town Square at this number about my website request.” That box is never pre-checked, and leaving it unchecked does not change anything else about your request.

Texts are sent by High Desert Media LLC, d/b/a River Valley Town Square, from our business line,(479) 315-4503, and each message names River Valley Town Square.

What we text about: your website request or claim, such as confirming we got it, asking a question about your business, sending a link to your mockup, and scheduling a call. We do not send unrelated marketing texts.
Message frequency varies with your request. Most people get a few messages over the course of a project.
Message and data rates may apply. Contact your wireless carrier for details about your plan.
Consent to receive text messages is not a condition of purchase. You can get a mockup and buy any of our services without agreeing to texts.

Opt-Out

You can opt out at any time by replying STOP to any text message from us. You will get one message confirming you are unsubscribed, and no more texts after that unless you opt in again (for example, by replying START).

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Privacy

We do not sell or share your mobile number or text opt-in with third parties or affiliates for their marketing purposes. See our Privacy Policy for details.

Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to our systems or networks
Interfere with or disrupt the Services or servers connected to the Services
Transmit any viruses, malware, or other harmful code
Harvest or collect information about other users without their consent
Use the Services to send unsolicited communications (spam)
Impersonate any person or entity or misrepresent your affiliation

Intellectual Property

All content on the Services (including text, graphics, logos, images, audio, video, and software) is the property of High Desert Media LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from our Services without prior written permission, except for personal, non-commercial use as permitted by applicable law.

User-Submitted Content

If you submit content to us (such as tips, stories, photos, or comments), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and distribute that content in connection with our Services. You represent that you have the right to submit such content.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, High Desert Media LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.

Our total liability for any claim arising from or related to these Terms or the Services shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless High Desert Media LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites. Accessing third-party links is at your own risk.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Arkansas.
